Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) govern your access to and use of the Exiwik platform, websites, and services (collectively, the “Service”) operated by Exiwik (“Exiwik”, “we”, “us”). By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

2. The Service

Exiwik is a business-to-business exhibition management platform that allows event organisers to create and manage exhibitions and conferences, exhibitors to manage booths and capture leads, and visitors to register and attend events. We may add, change, or remove features at any time, and we may impose limits on certain features or restrict access to parts of the Service.

3. Accounts

You must provide accurate information when registering and keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at support@exiwik.com if you suspect any unauthorised use. You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.

4. Subscriptions and payments

Event organisers may purchase paid subscriptions or add-on packs to access certain features. Exhibitors and visitors do not pay Exiwik to use the Service. Fees are billed in advance through our payment processors and, except where required by law, are non-refundable. Subscriptions renew automatically unless cancelled before the renewal date. We may change our prices on reasonable notice, with changes taking effect at your next billing cycle.

5. Acceptable use

You agree not to:

• use the Service for any unlawful, fraudulent, or harmful purpose;
• upload content that infringes the rights of others or that is defamatory, obscene, or misleading;
• attempt to gain unauthorised access to the Service, other accounts, or our systems;
• interfere with or disrupt the integrity or performance of the Service;
• send unsolicited communications (spam) to other users or registered visitors;
• scrape, harvest, or resell data obtained through the Service.

6. Your content

You retain ownership of the content you submit to the Service, including event details, exhibitor profiles, and uploaded materials (“Your Content”). You grant Exiwik a worldwide, non-exclusive licence to host, store, display, and process Your Content solely to provide and improve the Service. You are responsible for ensuring you have the rights to submit Your Content and that it complies with these Terms and applicable law, including data protection law where you collect information about visitors or other individuals.

7. Intellectual property

The Service, including its software, design, and branding, is owned by Exiwik and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or other brand features without our prior written permission.

8. Third-party services

The Service relies on third-party providers for infrastructure, email delivery, and payment processing (for example, hosting, database, transactional email, and payment gateways). Your use of the Service may be subject to those providers’ terms, and we are not responsible for their acts or omissions.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, Exiwik will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases, and we may delete Your Content in accordance with our data retention practices.

12. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, for example by email or through the Service. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of India, and the courts of Kerala, India will have exclusive jurisdiction over any dispute, except where mandatory local law provides otherwise.
